Michael Dubb, who heads the ownership group that campaigns Magna Light (Magna Graduate), has filed an appeal with the New York State Gaming Commission on Magna Light's disqualification in the GIII Sanford S. Saturday at Saratoga. The Rudy Rodriguez trainee set the early pace and still had a comfortable lead by midstretch, but veered out sharply before bearing back in, impeding Percolator (Flashy Bull), who hit the wire third, according to the stewards (video). He was disqualified from first and placed third.
“It's the only process available to us that we know of that we can use to try and reverse what we think is a bad decision,” Dubb explained.
As to the decision to appeal, Dubb stated, “There are two distinct issues. The first is whether they made the right call or not and the second is whether or not they pick on Rudy.”
Dubb declined to further comment on the issue on the advice of his counsel.
